论邻地通行与另辟通道——以梁某诉神农公司案为例

本文以梁某诉神农公司案为例,分析了我国物权法邻地通行权设计中存在的问题。我国物权法只对周围地的邻地通行权做了规定,没有对非周围地的通行权做出规定。本文指出,我国无偿通行的规定不符合国际惯例,也不利于提高土地资源利用效率,通行权人需要对周围地所有权人的损失等进行补偿,但无需对特殊邻地通行权进行补偿。同时认为,对历史形成的通道进行的"划道"行为不是另辟通道。从土地用途变迁的历史维度出发,强调应当灵活理解"通道应当为土地通常使用所必要"。

关于《红楼梦》中《警幻仙姑赋》的争议历来颇多。它与曹植的《洛神赋》在文字表达等方面有太多相似之处。从挖掘《洛神赋》背后的深意入手,可最终得出这样的结论：对残酷现实的情感宣泄以及人生理想的幻灭是曹雪芹效仿《洛神赋》的根本目的,更是创作《警幻仙姑赋》的深层动机;同时《警幻仙姑赋》在体裁选择及写作手法上所体现出的＂师楚＂情结,也使《警幻仙姑赋》的悲剧意味得以进一步延伸和升华。     

从俞平伯晚年自省和“李希凡自述”想到的(之三)——回应俞平伯晚年的红学研究反思

俞平伯先生晚年的红学自省是真实可信的,应引起红学界高度重视,他的红学研究思想的重大变化同1954年那场对他的批评有内在的因果关系。对当年那场"批俞评红"不能全盘否定,不能只讲负面问题,全面否定其正确性和必要性。现在红学研究的一些乱象正是当年批判过了的错误研究思想、研究方法的泛滥。这种泛滥同对当年的全盘否定不无关系。     

Planning an integrated agriculture and health program and designing its evaluation: Experience from Western Kenya

Multi-sectoral programs that involve stakeholders in agriculture, nutrition and health care are essential for responding to nutrition problems such as vitamin A deficiency among pregnant and lactating women and their infants in many poor areas of lower income countries. Yet planning such multi-sectoral programs and designing appropriate evaluations, to respond to different disciplinary cultures of evidence, remain a challenge. We describe the context, program development process, and evaluation design of the Mama SASHA project (Sweetpotato Action for Security and Health in Africa) which promoted production and consumption of a bio-fortified, orange-fleshed sweetpotato (OFSP). In planning the program we drew upon information from needs assessments, stakeholder consultations, and a first round of the implementation evaluation of a pilot project. The multi-disciplinary team worked with partner organizations to develop a program theory of change and an impact pathway which identified aspects of the program that would be monitored and established evaluation methods. Responding to the growing demand for greater rigour in impact evaluations, we carried out quasi-experimental allocation by health facility catchment area, repeat village surveys for assessment of change in intervention and control areas, and longitudinal tracking of individual mother-child pairs. Mid-course corrections in program implementation were informed by program monitoring, regular feedback from implementers and partners’ meetings. To assess economic efficiency and provide evidence for scaling we collected data on resources used and project expenses. Managing the multi-sectoral program and the mixed methods evaluation involved bargaining and trade-offs that were deemed essential to respond to the array of stakeholders, program funders and disciplines involved.     

Cloud manufacturing system for sheet metal processing

Abstract

Cloud computing is changing the way industries and enterprises run their businesses. Cloud manufacturing is emerging as an approach to transform the traditional manufacturing business model, while helping the manufacturer to align production efficiency with its business strategy, and creating intelligent factory networks that enable collaboration across the whole enterprise. Many production planning and control (PPC) problems are essentially optimisation problems, where the objective is to develop a plan that meets the demand at minimum cost or maximum profit. Because the underlying optimisation problem will vary in the different business and operation phases, it is important to think about optimisation in a dynamic mechanism and in a number of interlinked sub-problems at the same time. Cloud manufacturing has the potential to offer decision support as a service and medium of communication in PPC. To solve these problems and produce collaboration across the supply chain, this paper provides an overview of the state of the art in cloud manufacturing and presents a model of cloud-based production planning and production system for sheet metal processing.     

太平天国战争时期江西信丰的围城与守城——以吴秉衡《信丰守城记事略》为中心的讨论

自咸丰六年(1856)至同治三年(1864),信丰县城及县境经受了与太平军的多次战争,县城几番被围,最长的一次达二百二十余日。由于南赣官府、周边州县以及湘军的支援,另外署理知县吴秉衡的坚守,信丰县城得以保完。署理信丰知县吴秉衡的《信丰守城记事略》记载了太平军、匪寇围城的经过,该文献为认识咸、同时期江西地方史的重要史料,至今尚未得到学界的分析与解读。本文以《信丰守城记事略》等史料为主,讨论了太平军、匪寇的攻城策略,官府的应对措施以及信丰城乡战时的社会秩序等问题。     

Nonparametric regression with cross‐classified responses

In this article, we develop regression models with cross‐classified responses. Conditional independence structures can be explored/exploited through the selective inclusion/exclusion of terms in a certain functional ANOVA decomposition, and the estimation is done nonparametrically via the penalized likelihood method. A cohort of computational and data analytical tools are presented, which include cross‐validation for smoothing parameter selection, Kullback–Leibler projection for model selection, and Bayesian confidence intervals for odds ratios. Random effects are introduced to model possible correlations such as those found in longitudinal and clustered data. Empirical performances of the methods are explored in simulation studies of limited scales, and a real data example is presented using some eyetracking data from linguistic studies. The techniques are implemented in a suite of R functions, whose usage is briefly described in the appendix.
